1. Introduction
The following General Conditions of Sale regulate the offer and sale of products on the website https://www.padmea.it (“Site”) between PADMEA di Francesca Trenta (hereinafter: “PADMEA” or “Company”) and the end consumer (hereinafter: “Customer”).
2. General information
By virtue of the orders placed by the Customer and regularly received and accepted by the Company with this contract, “” transfers or undertakes to transfer ownership of said goods to the Customer and the latter pays or undertakes to pay the price thereof.
Goods can be purchased using the following methods:

Products for purchase are presented on the website, via email, in paper or electronic catalogs, by post, and by telephone. "PADMEA" serves the end consumer, who receives the products for sale. VAT-registered customers who wish to receive an invoice must request one, providing all relevant information at the time of ordering.
E-commerce is available exclusively to adult end users. Therefore, to proceed with a purchase, you must declare that you are an adult.
The products will remain the property of “PADMEA” until the customer has paid the purchase price, any shipping costs and any other additional costs, as indicated in the purchase order and according to the methods set out in the following point.
3. How to order – sales contract
The order can be placed through the channels indicated in the previous point 2.
Specifically, when using the Website, the customer selects the products or offers that are automatically added to the cart. To confirm their purchases, the customer accesses the cart section by clicking the "Shopping Cart" button and fills out the order form that appears on the screen. The contents of the order form (products or errors) can be modified by the customer at any time before completing the order. Along with the cart contents, the customer will see the corresponding amount to pay, which will be automatically updated if the customer changes the selected products or quantities.
By clicking on the relevant button, the customer will continue and fill out the form with the information necessary for invoicing (if required), payment, and delivery.
Before final confirmation, the cart will be displayed again with the corresponding amount to be paid.
The sales contract will be deemed finalized only when the customer has accepted the terms and conditions of sale set forth in the contract by clicking the "Buy Now" button. If the customer does not confirm acceptance of the sales contract by selecting the "Buy Now" button, the sales contract will not be deemed finalized. No payment will be due, and the customer will not receive the selected products. "PADMEA" will send the customer an email summarizing the order and its status, pursuant to art. 13 of Legislative Decree 70/2003, containing the following information: a summary of the general and specific terms and conditions applicable to the contract, information regarding the essential characteristics of the goods or services, a detailed indication of the price and payment methods, a detailed indication of the right of withdrawal, delivery costs, and applicable taxes.
If the product presented on the site is no longer available or on sale after the purchase order has been sent and the payment has been made, “PADMEA” will promptly inform the customer of the unavailability of the product and will contact the customer to arrange an alternative:
replacement with another product of equal value, upon sending the duly signed "replacement confirmation" form; or the refund of the price paid, which "PADMEA" will provide within 5 (five) days.
It is not possible to replace the purchased product with another one without additional costs.
In the case of promotional offers, the customer can purchase one or more individual offers.
4. Product description, features and prices
The products are presented and described on the website, in specific online offers, and in sales emails that may contain specific links.
The prices of the goods presented are expressed in euros and include VAT. The duration of any promotions and offers is indicated next to the product or offer to which they refer, as are the applicable prices.
Exclusive offers or "flash sales" on products published on the site or sent via email have a limited duration, which is always indicated and is valid while stocks last. The expiration date of the offers is indicated on the site and communicated to registered customers.
Any additional costs, where applicable, are indicated next to the product to which they apply.
An out-of-stock item included in a promotional offer will be replaced with an alternative item of the same value. If an entire package or most of the ordered products are out of stock, "PADMEA" will contact the customer.
10% First Registration Discount: Upon first registration, each user will receive a 10% discount code, which can be used on the first purchase of any product category published on the site, with the exception of "give a dinner" gift cards.
5. Shipping costs
Shipping costs are required, and the amount varies depending on the number of boxes, weight, and destination of the goods. Shipping costs are always indicated and visible during the checkout process.
Shipping costs may be free above a predetermined cart value, which can be changed without notice at any time. This value is displayed on the website. If payment for products is made via gift card or voucher, shipping costs are always due.
Shipping costs and any other additional costs, including VAT and expressed in Euros (€), will be expressly and separately indicated on the order form before the User submits it, as well as in the order acceptance email from "PADMEA". The price of the products published on the Site may be changed without notice, it being understood that the price charged to the User will be the one indicated on the product sheet at the time the User places the order.
For bulky packages or for particularly valuable goods, a packaging fee may be required. The amount varies depending on the product being delivered and is clearly indicated in the documentation—paper or electronic—that allows you to complete the order.
6. Payment Methods
We accept: Stripe and major credit card networks.
Please note that "PADMEA" will not charge Customers for the use of the aforementioned payment cards, or, in cases expressly established and communicated, fees that exceed those incurred by "PADMEA". The payment card issuer will refund the Customer for payments in the event of a charge exceeding the agreed price or in the event of fraudulent use of the payment card by "PADMEA" or a third party. The payment card issuer has the right to charge "PADMEA" for the amounts refunded to the Customer.
If for any reason the customer's payment is refused, "PADMEA" will refuse the customer's purchase order and notify the customer by email.
The amount due, as resulting from the purchase order sent by the customer and accepted by "PADMEA", will be charged at the end of the purchase procedure only after the credit card details used by the customer have been verified and the credit card company has issued authorization to charge the amount.
7. Delivery terms and responsibilities
The order fulfillment process is carefully managed and takes time. "PADMEA" undertakes to deliver the ordered goods within 4 (four) business days for deliveries in Italy and 8 (eight) business days for deliveries outside Italy for orders placed with electronic payment (credit card, Stripe).
Delivery is deemed completed when the ordered goods enter the possession of the customer or the person authorized by the customer to collect them. If these deadlines cannot be met (e.g., products not in stock), "PADMEA" undertakes to notify the customer using the most timely means to inform them and indicate when the goods can be delivered.
8. Goods damaged upon delivery
If the courier delivers damaged, broken, or stained packages due to leakage, the customer is required to refuse the shipment, expressly indicating the reason on the courier's delivery form. "PADMEA" will return the shipment via courier.
If a shipment contains multiple packages and not all are damaged, the customer has the right to refuse delivery and return the damaged package only. This can be done by signing the courier's "With Reserve" delivery form and indicating the number of damaged and returned packages. "PADMEA" will return the shipment via courier, at no additional cost to the customer.
The damaged product will be replaced by "PADMEA" at no cost to the customer, within 15 (fifteen) business days of delivery. If the product to be replaced is out of stock, "PADMEA" will promptly contact the customer to arrange an alternative replacement with another product of equal value, upon submission of the duly signed "replacement confirmation" form, and a refund of the price paid, which "PADMEA" will process within 5 (five) business days.
The shipping costs for returning the damaged package to “PADMEA”, for redelivery of the replacement products to the customer and any costs for refunding the price are borne by “PADMEA”.
9. Returns and replacement of defective goods
In the event that the customer finds a defect in the product or products delivered, the customer is required to promptly notify PADMEA by email at info@padmea.it, indicating the problem encountered and specifying their name and surname, order number, a detailed description of the defect found, attaching accompanying photographs, and making the deemed defective product available to PADMEA.
“PADMEA” will verify the defects complained of by the customer. If found, the defects will give the right to replace the product or products, after notification to the customer's email address.
“PADMEA” replaces the defective product or products at its own expense and covers the costs of return. If the products initially requested by the customer are out of stock, “PADMEA” will refund the amount paid by the customer as soon as possible and in any case within 3 (three) days of receiving the authorization notice from “PADMEA”.
If the customer receives a damaged or stained package from the courier due to product leaking from damaged boxes, "PADMEA" requests the customer to refuse the shipment. In this case, "PADMEA" will arrange for the return shipment. All costs for returning the damaged package and any subsequent costs for reshipping the product as quickly as possible will be borne by "PADMEA".
10. Unsolicited supplies
Unless the Customer consents, to be expressed before or at the time of conclusion of the contract, “PADMEA” will not carry out any supply other than that agreed upon, even if of equivalent or superior value and quality.
If the Customer receives an unwanted supply, he or she must notify PADMEA Customer Service by email at info@padmea.it so that PADMEA can collect the supply and refund any sums already paid.
11. Right of withdrawal
Article 52 of Legislative Decree 21/2014 allows the Customer to exercise the right of withdrawal (i.e., the right to return the goods, for any reason and without providing justification and without any charge) 14 (fourteen) days after delivery of the goods. Therefore, the Customer may exercise the right of withdrawal within 14 (fourteen) days of receiving the ordered goods, simply by notifying "PADMEA." The right of withdrawal may be exercised by submitting an explicit declaration of the Customer's decision to withdraw from the contract, via email to info@padmea.it.
12. Exclusion of liability in case of force majeure
Under no circumstances may “PADMEA” be held liable for failure to fulfill any of its obligations under these General Conditions of Sale in the event that the failure to fulfill is caused by unforeseeable circumstances and/or force majeure, including, but not limited to, natural disasters, terrorist acts, network malfunctions and/or blackouts.
13. Suspension of service
PADMEA reserves the right to temporarily suspend, without prior notice, the operation of the Site for the time strictly necessary for technical interventions necessary and/or appropriate to improve the quality of the services offered.
“PADMEA” may, at any time, interrupt access to the service offered on the Site to the User, if there are justified reasons (security or breaches of confidentiality or improper use of the Site), in which case it will promptly notify the User.
14. Legal Guarantee
Items and accessories included with offers are guaranteed for two (2) years against any manufacturing or functional defect. Damage due to wear and tear, improper use, or improper maintenance is excluded from the warranty.
The legal guarantee of conformity protects the Customer in the event of the purchase of defective products that malfunction or do not meet the intended use stated by "PADMEA" or the manufacturer of the goods or for which the goods are generally intended. The Customer may assert their rights under the legal guarantee of conformity by contacting the manufacturer of the goods directly, even if different from "PADMEA". In the event of a lack of conformity, the Customer has the right, at their discretion, to repair or replace the defective goods, free of charge, unless the requested remedy is impossible or excessively costly compared to the other remedy. If replacement or repair are not possible, the Customer is still entitled to a price reduction or a refund commensurate with the value of the goods, upon returning the defective product to "PADMEA". The legal guarantee lasts for 2 (two) years from delivery of the goods and must be asserted by the Customer within 2 (two) months of discovering the defect.
15. Competent forum
For any civil dispute between “PADMEA” and the Customer arising from the interpretation of the law and the conditions presented here, the Court of Cagliari shall have jurisdiction.
16. Closing rules
These General Conditions of Sale are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005 on the Consumer Code, with specific reference to the legislation on distance contracts, and by Legislative Decree no. 70 of 9 April 2003 concerning electronic commerce, where applicable.
The General Conditions of Sale may be periodically modified based on market developments, as well as in compliance with any legislative updates and changes. All updates and changes will be regularly published on the Site, and "PADMEA" invites the customer to periodically check for such updates and changes.
